Proviquer Servicios de Salud SA de CV, hereinafter PROVIQUER, in order to respect the rights and interests of its customers, suppliers, employees, or third parties who share their information with PROVIQUER, in relation to their personal data and in compliance with the provisions of Article 15 of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and its regulations (hereinafter the “Regulations”), issues this Comprehensive Privacy Notice.

Responsible for the protection of your personal data. The company named PROVIQUER, with registered address at Calle Havre 239-Consultorio 10, Díaz Ordaz, Puerto Vallarta, Jalisco, 48310, Mexico, and website, proviquer.com, is responsible for the use and protection of your personal data.

Purposes of the processing of your personal data. Your personal data is collected, used, stored, or transferred, to the extent permitted by applicable laws, for the purposes described below: Main purposes. (i) To comply with obligations contracted with our patients; (ii) to compile your medical record and in general; (iii) to provide the services and products you require; (iv) financial, legal, billing, and collection management; (v) the assessment, preservation, care, improvement, and recovery of your present, past, or future physical or mental health, as well as genetic information; (vi) to address complaints, claims, reports, and clarifications; (vii) to verify the source of business income. Secondary or ancillary purposes. (i) To provide you with commercial information about PROVIQUER products, including information related to promotions, new products, and any other promotional or related matters concerning our products and/or services; (ii) to conduct studies on consumer habits; and (iii) on some occasions, information will be used to present clinical cases, with the prior consent of the patient and without revealing their identity. It will be limited to the purposes set forth herein, and if we intend to process your personal data for a purpose other than those set forth in this Privacy Notice, PROVIQUER will require your consent for such purpose again. Personal data. For the purposes outlined in this privacy notice, we may collect your personal data in different ways: (i) when you provide it to us directly, (ii) when you visit our website, (iii) when we obtain information through other sources that are permitted by law, and (iv) when you contract our services. Personal data we collect directly: First and last names and/or company name, address, Unique Population Registry Code (CURP), marital status, date of birth, place of birth, landline (home or office), cell phone, federal taxpayer registration number, photograph, email address, and constituent data (in the case of a legal entity). Personal data that we collect through this medium may include: Name(s) and surname(s), address, landline telephone number (home or office), cell phone number, email address. Personal data will be collected by filling out physical or remote forms, and/or by compiling information or documentation required by PROVIQUER, either in person or electronically on any of its websites.

PROVIQUER collects sensitive personal data from its customers, which is their current, past, or future physical health status.

If no transaction is carried out with you, the data you have provided will be blocked and subsequently deleted. Blocked information may be retained for the period necessary to comply with legal provisions, such as tax or commercial provisions, and will subsequently be deleted.

Consent and purposes. Changes to the Privacy Notice. PROVIQUER reserves the right to make changes or updates to this Privacy Notice at any time in order to comply with new legislation or case law, internal policies, new requirements for the provision or offering of its products and services, or commercial practices. Therefore, in the event that PROVIQUER modifies the content of this Privacy Notice, it will inform you through our website, proviquer.com. PROVIQUER is not responsible if the owner does not read this notice and is not aware of its scope.

Transfer of personal data. Your personal data may be transferred to subsidiaries, affiliates, and parent companies of PROVIQUER, and even to third parties, domestic or foreign, unless you (the owner) expressly state your opposition, in accordance with the provisions of the Law and its Regulations. In these cases, PROVIQUER will transfer the personal data after entering into confidentiality agreements, provided that (i) the supplier or person to whom the data is transferred agrees to subject the processing of personal data to this Privacy Notice, except in the cases established in Article 37 of the Law. If you do not express your opposition to the transfer of your personal data to third parties, it will be understood that you have tacitly given PROVIQUER your consent to do so.

Revocation of consent and rights of access, rectification, cancellation, or opposition. As the owner of personal data and in accordance with Chapter IV, Article 29 of the FEDERAL LAW ON THE PROTECTION OF PERSONAL DATA HELD BY PRIVATE ENTITIES, you may submit or send a request to PROVIQUER’s personal data department to revoke your consent, access, rectify, limit, cancel, or oppose the use of your personal data. The personal data department will process your requests and promote the protection of personal data within PROVIQUER. For any request of this type that falls within the competence of PROVIQUER’s Personal Data Department, please send an email to a.proviquer@gmail.com. You may revoke any consent you may have given us for the processing of your personal data. However, it is important to note that we will not be able to comply with your request or terminate use immediately in all cases, as we may be required by law to continue processing your personal data. You should also bear in mind that, for certain purposes, revoking your consent means that we will no longer be able to provide the service you have requested and that your relationship with us will be terminated.
Duration. The duration of the processing of the personal data mentioned above will be directly related to the continuity of the provision and/or promotion of the services provided by the COMPANY to the User. In any case, the COMPANY may process your data until you personally request the cancellation or opposition of such processing. Statistical or disaggregated data will at all times be the property of the COMPANY. The personal data you provide us about yourself is received and stored in our own databases and servers. Once the provision and/or promotion of the requested services has been completed, upon cancellation by you, by giving prior notice to the COMPANY, your data must be dissociated from your identity within a period of no more than 20 (twenty) business days. Once the data has been dissociated, it will be stored indefinitely as statistical information.
Notwithstanding the foregoing, in accordance with the provisions of Articles 38 and 49 of the Commercial Code, 158, section III, of the General Law on Commercial Companies, 30 and 67 of the Federal Tax Code, the COMPANY will store the data relating to the acquisition of the provision of services and their billing (such as invoices, name of the buyer, RFC, tax and/or legal address of the buyer, information on the means of payment used by the buyer, etc.) for a period of ten years, for the purpose of complying with the applicable tax and commercial obligations. Once this period has elapsed, your data must be dissociated from your identity within a period of no more than 20 (twenty) business days, and any documents that could lead to your identification must be destroyed. Once the data has been dissociated, it will be stored indefinitely as statistical information.

Informative note: If you believe that your right to data protection has been violated by any conduct or omission on our part, or if you believe that there has been a violation of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its regulations, and other applicable laws, you may file a complaint with the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI).
